These Terms and Conditions (“Terms”) govern your use of the website christinehazel.photography (“Website”) and describe certain general policies of Christine Hazel Photography LLC (“Company,” “we,” “us,” or “our”).

By accessing or using this Website, you agree to these Terms. If you hire Christine Hazel Photography LLC for photography services, your services will also be governed by a separate written agreement. In the event of any conflict or inconsistency between these Terms and a signed client agreement, the signed client agreement will control with respect to the photography services covered by that agreement.


1. Website Use

You agree to use this Website only for lawful purposes and in accordance with these Terms. You may not use the Website in a manner that could damage, disable, interfere with, or impair the Website, its security, or another person's use of the Website.

You may not, without authorization:

  • Copy, scrape, reproduce, republish, distribute, or commercially exploit Website content;
  • Attempt to gain unauthorized access to the Website, its systems, or associated accounts;
  • Transmit malicious software, code, or other harmful material;
  • Use automated systems to collect Website content or data except as permitted by applicable law; or
  • Use the Website for fraudulent, unlawful, abusive, or misleading purposes.

We reserve the right to restrict access to the Website when reasonably necessary to protect the Company, the Website, its users, or our intellectual property.


2. Intellectual Property

Unless otherwise stated, the photographs, text, graphics, branding, logos, designs, educational materials, and other original content displayed on this Website are owned by or licensed to Christine Hazel Photography LLC and are protected by applicable intellectual property laws.

No Website content may be copied, reproduced, modified, republished, distributed, sold, licensed, or commercially exploited without prior written permission from Christine Hazel Photography LLC, except as otherwise permitted by law.

The display of photographs on this Website does not grant Website visitors any license or right to download, reproduce, edit, publish, distribute, or otherwise use those photographs.


3. Artificial Intelligence (“AI”) Disclaimer

Our Website and related materials may contain content created, edited, or developed with the assistance of artificial intelligence (“AI”) technologies, including, but not limited to, AI-generated or AI-assisted text, images, videos, and/or audio.

AI technology may be used as a tool by Christine Hazel Photography LLC to supplement, enhance, edit, research, brainstorm, or make suggestions regarding our content. This may include the use of AI-assisted tools in the photography workflow, including post-processing, culling, masking, retouching, or similar editing functions. The use of AI-assisted image-editing technology does not necessarily mean that the underlying photograph was generated by AI.

AI does not replace our human judgment or creative decision-making. The thoughts, ideas, opinions, creative direction, selection, arrangement, editing, and final presentation of our content are substantially human-directed, and finished content is reviewed by a human before publication or delivery.

To the extent permitted by applicable copyright law, Christine Hazel Photography LLC retains all rights in the original, human-authored elements of our content and in any protectable selection, arrangement, modification, or other authorship contributed by Christine Hazel Photography LLC. Nothing in these Terms is intended to claim copyright ownership over material that is not eligible for copyright protection under applicable law.

Christine Hazel Photography LLC may also use AI technologies as an aid in responding to common customer questions through chat or other automated communication tools. When an automated AI-powered chat tool is used, we will identify the interaction as automated where required by applicable law. While we strive to ensure that information provided with the assistance of AI is accurate and reliable, AI systems are not infallible and may occasionally produce incomplete, outdated, or incorrect information.

Information or recommendations produced through an AI-powered chat or other automated technology are provided for general informational purposes only and should not be relied upon as a substitute for information provided directly by Christine Hazel Photography LLC or incorporated into a signed client agreement. For assistance from a human, please contact christine@christinehazel.photography.

Christine Hazel Photography LLC may use AI technologies and AI-generated or AI-assisted materials pursuant to licenses, terms, or permissions granted by third-party AI platforms. You understand and acknowledge that we cannot guarantee the accuracy, completeness, availability, or reliability of content generated by third-party AI technologies. To the fullest extent permitted by applicable law, your reliance upon information generated by an AI system is at your own risk.

If AI-generated information conflicts with a signed agreement between you and Christine Hazel Photography LLC, the terms of the signed agreement will control.


4. Privacy and Cookies

Your use of the Website is also subject to our Privacy Policy and Cookie Policy. These policies explain how we collect, use, disclose, and protect personal information and how cookies and similar technologies may be used on the Website.


5. Inquiries and Booking Photography Services

Submitting an inquiry, communicating with Christine Hazel Photography LLC, receiving pricing information, or discussing potential services does not reserve a date or create a photography services agreement.

Unless otherwise agreed in writing, photography services are considered booked only after the applicable written agreement has been signed and the required non-refundable retainer has been received.

Availability, pricing, collections, products, services, and other offerings displayed or discussed through the Website are subject to change until a binding client agreement has been executed.


6. Portrait Photography

The following describes general policies applicable to portrait photography services. The specific terms of each portrait engagement are governed by the client's signed agreement.

Retainer and Payment

Portrait photography generally requires a non-refundable retainer equal to 50% of the contracted service price to reserve the session date. Unless otherwise provided in the signed agreement, the remaining balance is due one week before the scheduled portrait session.

Cancellation and Rescheduling

Portrait retainers are non-refundable. Unless otherwise provided in the signed agreement, a portrait session may generally be rescheduled without an additional rescheduling charge when at least 7 days' notice is provided. A rescheduling request made fewer than 7 days before the session generally requires payment of a new retainer.

When weather may materially affect a portrait session, Christine Hazel Photography LLC determines whether a weather-related reschedule is necessary. We generally communicate a weather decision approximately 24 hours before the scheduled session. A weather-related reschedule initiated by Christine Hazel Photography LLC does not constitute a client cancellation.

Portrait Deliverables

Unless otherwise specified in the signed agreement, portrait clients are guaranteed a minimum of 50 final edited photographs.

Delivery timing, specific products, albums, prints, and other deliverables are governed by the applicable client agreement and collection purchased.

Portrait Albums

When an album is included with a portrait collection, the client must finalize and approve the album design within one year of final gallery delivery. Album orders not finalized within that period may be subject to then-current album, production, shipping, or related pricing increases.


7. Wedding and Event Photography

The following describes general policies applicable to wedding and event photography services. Because each event is unique, the client's signed agreement governs the specific engagement and will control in the event of any inconsistency with these Website Terms.

Retainer and Payment

Wedding photography currently requires a $1,500 non-refundable retainer to reserve the wedding date, unless a different amount is specified in the signed agreement. The remaining balance for weddings and events is generally due 30 days before the event.

Failure to make a required payment when due may permit Christine Hazel Photography LLC to terminate the applicable agreement and decline to perform services not yet rendered, subject to the terms of the signed agreement.

Cancellation

Wedding and event retainers are non-refundable. Generally, when a client cancels more than 30 days before the scheduled event, Christine Hazel Photography LLC retains the retainer as provided by the signed agreement, but the client is not responsible for the remaining balance.

A cancellation within 30 days of the scheduled event may result in the entire contracted balance becoming due. Cancellation procedures, notice requirements, payment obligations, and any applicable exceptions are governed by the client's signed agreement.

Rescheduling

Wedding and event rescheduling is governed by the client's signed agreement. Factors including the amount of notice provided, Christine Hazel Photography LLC's availability for the new date, whether the original date can be rebooked, payments already made, then-current pricing, and applicable rescheduling fees may affect the client's ability to transfer payments to a new event date.

A rescheduled wedding or event may require a new agreement, new retainer, rescheduling fee, or updated pricing. Clients should refer to their signed agreement for the complete terms applicable to their booking.

No-Show and Client-Caused Nonperformance

If Christine Hazel Photography LLC is unable to perform services because of the client's failure to appear, the failure of essential participants or events to occur, or other circumstances caused by the client or parties associated with the client, payment obligations and refunds will be determined according to the signed agreement.

Wedding Deliverables

Unless otherwise specified in the signed agreement, wedding clients are guaranteed a minimum of 50 final edited photographs per contracted hour of photography coverage.

Final wedding galleries are delivered within 10 weeks of the wedding date, unless otherwise provided in the applicable client agreement or affected by circumstances addressed within that agreement.

Wedding Albums

When a wedding collection includes an album, an initial album design will be delivered with the final wedding gallery. The client must finalize and approve the album design within one year of final gallery delivery. Albums not finalized within that period may be subject to then-current album, production, shipping, or related pricing increases.


8. Photography Copyright and Client Usage Rights

Except where otherwise expressly agreed in writing, Christine Hazel Photography LLC retains the copyright to photographs created by the Company.

Clients receive the personal-use rights specified in their signed agreement. Such rights generally permit clients to download their delivered photographs, create prints for personal use, display photographs in their homes, and share photographs through personal websites and social media.

Unless separately authorized in writing, client usage rights do not include the right to sell photographs, license photographs to third parties, use photographs for commercial advertising or promotional purposes, or otherwise commercially exploit the photographs.

Commercial vendors, publications, venues, businesses, and other third parties should contact Christine Hazel Photography LLC regarding appropriate image usage or licensing.

Any usage rights provided to a photography client do not transfer copyright ownership unless Christine Hazel Photography LLC expressly agrees to such a transfer in writing.


9. Client Conduct, Safety, and Harassment

Christine Hazel Photography LLC is committed to providing professional services in an environment that is reasonably safe and respectful. Clients are expected to use reasonable efforts to provide safe and appropriate working conditions for the photographer, employees, contractors, and assistants.

We reserve the right to stop or suspend photography services when we reasonably believe circumstances present an actual or implied threat of injury, harassment, abuse, unsafe conduct, or danger to personnel or equipment.

Depending upon the circumstances, Christine Hazel Photography LLC may provide the client or another responsible party with an opportunity to address inappropriate behavior before ending coverage. Serious conduct or circumstances presenting an immediate safety concern may require us to discontinue services without providing additional warnings.

The detailed harassment, safety, termination-of-coverage, refund, and payment provisions applicable to a photography engagement are governed by the client's signed agreement.


10. Venue Rules and Circumstances Beyond Our Control

Photography may be affected by circumstances outside Christine Hazel Photography LLC's reasonable control, including venue rules, officiant restrictions, event schedules, weather, lighting, guest behavior, vendor interference, access limitations, government restrictions, or other conditions at a photography location.

Clients acknowledge that such circumstances may affect the photographs that can reasonably be created. Christine Hazel Photography LLC cannot guarantee particular photographs, poses, backgrounds, lighting conditions, locations, or results when circumstances outside our reasonable control prevent them.


11. Assumption of Risk and Property

Photography sessions and events may involve ordinary risks associated with locations, terrain, weather, movement, poses, crowds, or other circumstances. Clients are responsible for following reasonable safety instructions and for determining whether they are comfortable participating in a particular activity, pose, or location.

To the fullest extent permitted by applicable law and subject to the applicable signed agreement, Christine Hazel Photography LLC is not responsible for injuries, illness, or property damage caused by circumstances outside our reasonable control or by the acts or omissions of clients, guests, vendors, venues, or other third parties.

If Company equipment or property is damaged or lost because of the intentional, reckless, or negligent conduct of a client or a person associated with the client, the client may be responsible for the resulting repair or replacement costs as provided in the signed agreement and applicable law.


12. Website Information and Third-Party Links

We make reasonable efforts to keep information on this Website accurate and current. However, Website content is provided for general informational purposes and may occasionally contain errors, omissions, outdated information, or information that changes after publication.

The Website may contain links to websites, products, services, venues, vendors, publications, or other resources operated by third parties. Christine Hazel Photography LLC does not control those third parties and is not responsible for their content, availability, security, privacy practices, products, services, representations, or actions.

A link, recommendation, mention, or feature does not necessarily constitute an endorsement or guarantee.


13. Limitation of Liability

To the fullest extent permitted by applicable law, Christine Hazel Photography LLC will not be liable for indirect, incidental, special, punitive, or consequential damages arising solely from use of, or inability to use, this Website.

Liability arising from contracted photography services is governed by the limitation-of-liability and related provisions contained in the applicable signed client agreement.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.


14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.

Before commencing litigation concerning a dispute arising from these Website Terms, the parties agree to make a good-faith effort to resolve the dispute informally and, when appropriate, through mediation in Middlesex County, Massachusetts, with Framingham preferred when reasonably available.

Any dispute concerning contracted photography services is subject to the dispute-resolution provisions contained in the applicable signed client agreement. If those provisions conflict with this section, the signed client agreement will control.


15. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, where permitted by law, and the remaining provisions will continue in full force and effect.


16. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.


17. Changes to These Terms

We may update these Terms from time to time to reflect changes to our Website, services, business practices, technology, or applicable law. When changes are made, the “Last Updated” date at the top of this page will be revised.

Your continued use of the Website after revised Terms are posted constitutes acceptance of the revised Terms to the extent permitted by applicable law. Changes to these Website Terms do not modify an existing signed client agreement unless agreed to as required by that agreement.
