These Terms and Conditions (“Terms”) govern your use of the website https://christinehazel.photography (“Website”) and outline the general policies that apply when booking photography services with Christine Hazel Photography LLC (“Company,” “we,” “our,” or “us”).

By accessing this Website, submitting an inquiry, joining our newsletter, or booking photography services, you agree to be bound by these Terms. For clients who hire the Company for wedding or portrait services, these Terms work in conjunction with, and are supplemented by, the signed contract you will receive through HoneyBook. In the event of a conflict between these Terms and a signed contract, the signed contract will govern.


1. Website Use

By using this Website, you agree to comply with all applicable laws and regulations and to use the Website only for lawful purposes. You may not use this Website to:

  • Make false, fraudulent, or speculative inquiries
  • Interfere with Website functionality or security
  • Copy, scrape, or reproduce Website content without permission
  • Upload or transmit harmful code or malicious software

We reserve the right to restrict or terminate access for any user who violates these Terms or engages in abusive, disruptive, or unlawful behavior.


2. Intellectual Property

All images, graphics, logos, text, and other content displayed on the Website are the exclusive property of Christine Hazel Photography LLC unless otherwise noted. Nothing on the Website grants you a license to use, reproduce, modify, or distribute any content without our prior written consent.

Unlawful reproduction, screenshotting for commercial gain, or unauthorized editing of images is strictly prohibited.


3. Privacy & Cookies

Your use of the Website is also governed by our Privacy Policy and our Cookie Policy. Please review both policies to understand how we collect, use, and protect your personal information.


4. Booking Photography Services

Submitting an inquiry through the Website does not guarantee availability or create a contract for services. A booking is only confirmed once:

  • A contract is signed via HoneyBook, and
  • The required non-refundable retainer has been paid.

Retainers are applied toward the total cost of services and reserve your date exclusively. Retainers are non-refundable under all circumstances.


5. Portrait Photography Terms

A. Retainer & Payment

  • A non-refundable retainer of 50% is due at booking.
  • The remaining balance is due one week prior to the session date.

B. Rescheduling & Cancellations

  • Clients may reschedule a session once with at least 7 days’ notice at no additional fee.
  • Reschedules within 7 days require a new retainer.
  • Weather-related rescheduling is determined solely at the discretion of the photographer.
  • All retainers are non-refundable, regardless of cancellation reason.

C. Deliverables

  • Portrait clients are guaranteed 50 final edited images.
  • Delivery timelines are communicated at booking but typically fall within standard industry ranges.
  • If a portrait package includes an album, clients must finalize their design within one year of gallery delivery or be subject to current pricing.

6. Wedding Photography Terms

A. Retainer & Payment

  • A non-refundable retainer of $1,500 is required at booking.
  • The remaining balance is due 30 days before the wedding date.
  • Failure to pay the balance by the due date may result in cancellation of services.

B. Cancellations

  • If the Client cancels more than 30 days before the wedding date, the retainer is forfeited but no further payment is due.
  • If the Client cancels within 30 days of the wedding date, the full balance is due.
  • All cancellations must be submitted in writing via email, and receipt must be confirmed by the Company.

C. Rescheduling

Rescheduling follows the policies in your signed wedding contract. In summary:

  • Rescheduling more than 30 days in advance may allow transfer of payments if the Company can rebook the original date.
  • A new retainer and a 25% rescheduling fee apply when rebooking under a new contract.
  • Rescheduling within 30 days forfeits all payments and requires payment of the full balance.

D. No-Show or Client Fault

If the Company cannot perform services due to actions or negligence of the Client or associated parties, the Client forfeits all payments and remains responsible for the full balance.

E. Deliverables

  • Clients are guaranteed a minimum of 50 edited images per hour of contracted coverage.
  • Final wedding galleries are delivered within 10 weeks of the wedding date.
  • If the package includes an album, a draft will be delivered alongside the final gallery.
  • Clients must approve album designs within one year of gallery delivery or be subject to current pricing.

7. Copyright & Usage Rights

Christine Hazel Photography LLC retains full copyright to all images created.

Clients receive a non-exclusive, non-transferable license to:

  • Download and store images
  • Print images for personal use
  • Share images online with proper credit
  • Display images in their home or personal spaces

Clients may not:

  • Edit, filter, or alter images in a way that misrepresents the photographer’s work
  • Sell or license images to third parties
  • Use images for commercial or promotional purposes without written permission

Vendors (florists, planners, venues, etc.) must request a usage license before publishing or using images commercially.


8. Client Conduct, Safety & Harassment Policy

The Client agrees to provide a safe, respectful working environment for the photographer and any assisting staff.

If harassment, unsafe conditions, verbal abuse, physical threats, or equipment risks occur, the Company may enact a three-strike policy or immediately end coverage. If the Company must leave early due to such behavior, no refund will be issued, and the Client remains responsible for full payment.

The Client also agrees that the photographer is not liable for:

  • Injuries sustained during poses, movement, or session participation
  • Illness transmission despite reasonable precautions
  • Damage to property caused by Client or guests
  • Limitations imposed by venue rules, weather, lighting, or guest interference

If Client or guest damages equipment, the Client agrees to reimburse the Company for repair or replacement costs.


9. Limitation of Liability

To the fullest extent permitted by law, the Company is not liable for:

  • Acts of God, emergencies, or events outside reasonable control
  • Lost opportunities, emotional distress, or consequential damages
  • Interference by guests, vendors, venue staff, or weather conditions

If unforeseen circumstances prevent the photographer from fulfilling contracted services, liability is limited to the return of all payments received, excluding any services already performed.


10. Governing Law, Mediation & Jurisdiction

These Terms are governed by the laws of the Commonwealth of Massachusetts.

In the event of a dispute, the parties agree first to pursue mediation in Middlesex County, Massachusetts, preferably in Framingham, before pursuing court action.

If mediation fails, disputes will be resolved exclusively in the state or federal courts serving Middlesex County.


11. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Your continued use of the Website constitutes acceptance of any revised Terms.
